THE UNIVERSITY COURT OF THE UNIVERSITY OF EDINBURGH, OLD COLLEGE, EDINBURGH, EH8 9YL, UK (“EDINBURGH”) ACTING THROUGH THE ITS SCHOOL OF PHILOSOPHY, PYSCHOLOGY AND LANGUAGE SCIENCES, THE UNIVERSITY OF EDINBURGH, TEVIOT PLACE (DOORWAY 1), EDINBURGH EH8 9AG, UK HAS DEVELOPED THE ON-LINE A LINGUISTIC ATLAS OF EARLY MIDDLE ENGLISH (“LAEME”) AND PROVIDES USE OF THE WEBSITE AND ITS ASSOCIATED DATABASE AND DOCUMENTATION (“THE LAEME WEBSITE”) ON THE FOLLOWING TERMS AND CONDITIONS.

1. Authorship Statement

LAEME was created and compiled by Margaret Laing (University of Edinburgh) with the collaboration of Roger Lass (University of Cape Town). The LAEME website was created by Margaret Laing, Keith Williamson and Vasilis Karaiskos (University of Edinburgh). LAEME and the LAEME website were made possible with financial support from a number of agencies and individuals. (See Funders.)

2. Copyright

2.0 The LAEME website and all of its contents (except for images, text and other materials which are acknowledged as having been provided by others) are the copyright of Edinburgh and reproduction is only permitted by you [“the User”] in accordance with the terms in 3. Terms and Conditions of Use below.

2.1 Edinburgh is the owner and proprietor of copyright, database right and all other intellectual property rights in and to the LAEME website and related documentation.

2.2 The database, data and documents developed specifically for the LAEME website are proprietary to Edinburgh and Edinburgh retains title and ownership of these and related documentation at all times. All copies of data and related documentation are the property of Edinburgh regardless of the medium in which such copies may exist.

2.3 The software developed specifically for the LAEME website is confidential and proprietary to Edinburgh and Edinburgh retains title and ownership of the software and related documentation at all times. All copies of the software and related documentation are the property of Edinburgh regardless of the medium in which such copies may exist.

2.4 The User undertakes to adopt any security measures needed to protect Edinburgh’s copyright, database right and other intellectual property rights in the LAEME website and to ensure that no unauthorised use is made of the LAEME database, data and related documentation.

3. Conditions and Terms of Use

3.1 You may use the LAEME website only for non-commercial, non-profit educational and research purposes.

3.2 You may view the database and download any part(s) of it (except for images, text and other materials which are acknowledged as having been provided by others) to file or print for the purposes of private reference, research, study or provision of teaching materials for classes taught by you within a recognized educational institution. You may not (a) store it or print out copies of it (or any part of it) other than for the purposes set out in this paragraph; or (b) reproduce, copy or transmit it (or any part of it) in any other way for any purpose or in any other medium, without our prior written permission.

3.3 Where images, text and other materials are acknowledged as having been provided by others, those others reserve all rights in these items and permission for any use must be obtained in writing from the relevant person or organisation.

4. Disclaimer of Warranty and Limitation of Liability

4.1 EDINBURGH GIVES NO WARRANTY TO THE USER THAT THE LAEME WEBSITE IS FREE FROM DEFECTS OR FAULTS. DATA AND SOFTWARE ARE PROVIDED “AS IS” WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. EDINBURGH MAKES NO REPRESENTATION ABOUT THE SUITABILITY OF THE LAEME WEBSITE FOR ANY PURPOSE.

4.2 TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL EDINBURGH AND / OR ITS EMPLOYEES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL LOSS AND / OR DAMAGES OF ANY KIND WHATSOEVER (INCLUDING, BUT NOT LIMITED TO, PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES; LOSS OF USE, DATA, OR PROFITS; FAILURE TO MAKE ANTICIPATED SAVINGS; COSTS OF WASTED TIME; COSTS OF MISSED BUSINESS OPPORTUNITIES; GOODWILL; OR BUSINESS INTERRUPTION) HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, STRICT LIABILITY, OR DELICT (INCLUDING NEGLIGENCE OR OTHERWISE) ARISING IN ANY WAY OUT OF THE USE OF, OR INABILITY TO USE, THIS SOFTWARE, EVEN IF SUCH WAS REASONABLY FORESEEABLE OR IF EDINBURGH AND / OR ITS EMPLOYEES WERE ADVISED OF THE POSSIBILITY OF SUCH LOSS AND / OR DAMAGE. EDINBURGH DOES NOT EXCLUDE LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY THE NEGLIGENCE OF EDINBURGH OR ITS EMPLOYEES.

5. No waiver

Failure by Edinburgh to exercise or enforce any rights in the LAEME website shall not be deemed to be a waiver of any such right nor operate so as to bar the exercise or enforcement thereof at any time or times thereafter.

6. Indemnification

The User agrees to indemnify and keep indemnified at all times Edinburgh on demand against any liability, loss or damage incurred by Edinburgh which arises directly or indirectly out of any breach of any of the undertakings or obligations on the part of the User contained in this licence or in respect of the use of the LAEME website by the User howsoever arising (save for such liability, loss or damages directly and solely caused by the wilful negligence of Edinburgh).
